Tenancy or lease renewal in Azerbaijan

Renewing a tenancy agreement in Azerbaijan typically involves reaching a mutual agreement with the landlord to extend the existing contract or signing a new document. The updated lease agreement should be formally registered with the appropriate state authorities to ensure legal protection for both parties.

Your timing

It is standard practice to initiate discussions regarding a lease renewal at least 30 to 60 days before the current contract expires. This provides sufficient time to negotiate terms and allows the relevant state services time to process the registration of the new or extended agreement.

Start 30 days ahead

Advance notice allows for administrative processing and ensures there is no period where the tenancy remains unregistered.

The process

  1. 1Consult the existing lease agreement to review specific clauses regarding renewal conditions and notice periods.
  2. 2Negotiate terms, including rent adjustments and lease duration, directly with the landlord.
  3. 3Draft a new lease agreement or an addendum to the original contract incorporating the updated terms.
  4. 4Sign the agreement in the presence of the landlord.
  5. 5Submit the signed contract to the State Service for Property Issues or a local ASAN Service center for official registration.

What to bring

  • Original and copy of the existing lease agreement
  • Identification documents (passports or residency cards) for all signatories
  • Proof of property ownership (Extract from the State Registry)
  • Notarized power of attorney, if a representative is acting on behalf of the landlord or tenant

Registration fees for property-related documents vary depending on the nature of the property and the duration of the lease; these must be confirmed directly with the local ASAN Service center or the State Service for Property Issues.

What commonly goes wrong

  • Failure to register the renewal may result in the contract not being legally enforceable in court disputes.
  • Verbal agreements for renewal are often not sufficient; written documentation is required for official registration.
  • Ensure that the landlord's property documents are current, as expired ownership certificates may prevent the registration of a new lease.
