Tenancy or lease renewal in Afghanistan

Written from published rules on 27 August 2026. Not monitored for changes since. A starting point, not official advice — confirm anything that matters with Ministry of Justice (وزارت عدلیه). Rules here vary, so check carefully.

Renewing a tenancy or lease agreement in Afghanistan generally requires a formal agreement between the landlord and tenant, typically documented in a new contract. These agreements are often registered with local authorities or notary offices to ensure legal validity and protect the interests of both parties.

Your timing

It is recommended to begin the renewal process at least 30 to 60 days before the existing lease expires. This allows sufficient time for negotiations on rent adjustments and the preparation of new documentation, which may require approval or stamping from local district offices or municipal authorities.

Start 45 days ahead

Processing times can fluctuate based on the requirement for formal notarization or registration at local district courts.

The process

  1. 1Initiate discussions with the landlord regarding the renewal terms and any adjustments to the rent or lease duration.
  2. 2Draft or update the lease agreement document, ensuring all updated terms are clearly stated in writing.
  3. 3Have both parties sign the new agreement in the presence of witnesses.
  4. 4Visit a local notary office (Mahkamah) or relevant municipal authority to register or legalize the contract if required by local regulations.
  5. 5Obtain copies of the stamped and legalized lease for both the tenant and the landlord's personal records.

What to bring

  • Original identification documents (Tazkera) for both the landlord and tenant
  • A copy of the expiring lease agreement
  • Evidence of property ownership (deed or documentation held by the landlord)
  • Any applicable registration or notary fees

Fees for lease registration or notarization vary significantly by municipality and the specific terms of the contract; these costs should be confirmed directly with the local notary or district authority.

What commonly goes wrong

  • Failure to formally register the lease can limit legal recourse in the event of a dispute.
  • Verbal agreements are generally not recognized as legally binding for property leases.
  • Ensure that the property owner holds the clear legal right to lease the premises before signing a renewal.
